NOTICE OF PUBLIC HEARING
BEFORE THE GRIDLEY PLANNING COMMISSION
NOTICE IS HEREBY GIVEN that the Gridley Planning Commission will hold a public hearing on the project described below. The hearing will be held on Monday, May 16, 2011 at 5:30 P.M. in Gridley City Hall Council Chambers, 685 Kentucky Street, Gridley. All interested persons are invited to attend or submit comments in writing.
Project:
The Planning Commission will conduct a public hearing to review proposed changes to the Gridley Municipal Code that will address front yard paving and landscaping. Without specific regulations, the Commission is concerned that paving large portions of yards may adversely affect adjacent properties by creating excessive runoff which is diverted into neighboring yards or into storm drains. In addition, paving front yards kills trees, prevents new trees from being planted and reduces the total amount of green space in residential areas. The changes to the Municipal Code will also require newly created (vacant) residential parcels to plant at least one tree within the front yard area.
The proposed changes are as follows:
GMC Residential yard requirements in AR-5, R-S, R-1, R-2 and R-3 districts are proposed as follows:
b. Front yard landscaping. Entire front yard shall be landscaped. For new dwelling units, an underground irrigation system with at least one shade tree from the city of Gridley approved list of trees in at least a five-gallon container size shall be planted within the front yard prior to final inspection or occupancy.
c. Walkways, parking areas, vehicular access ways and other impervious surfaces shall not collectively occupy more than 50% of the total front yard area between the principal dwelling unit and the front public or private street curb. Any paved areas in excess of this requirement in existence at the time of adoption shall be deemed legal nonconforming.
The Planning Commission will review the proposed amendment as it applies to Title 17 of the Zoning Ordinance at the 5:30 p.m. regular meeting and will make their recommendation to the City Council at an upcoming meeting.
Environmental Review Status: The proposed action is exempt from review under the California Environmental Quality Act section 15601 (b) (3) because it can be seen with certainty that the proposed amendments would not have a significant effect on the environment.
In accordance with Government Code Section 65009, if any person(s) challenges the action of the Planning Commission on this project in court, said person(s) may be limited to raising only those issues that were raised at the public hearings described in this notice, or in written correspondence delivered to the City Clerk, Planning Commission at, or prior to, the public hearing.
